Modification of Final Divorce and Custody Orders

After a case is closed, a party will frequently need a modification of the Final Order. Restraining Orders and Petitions for Protection from Abuse (PFA’s)

A Restraining Order is a legal tool utilized to protect victims of domestic violence or criminal abuse. A victim of domestic violence may petition the Court for an Order of Protection where the victim alleges acts by a spouse or the other parent. Such orders are frequently issued on a temporary basis, without the Defendant being aware of a court proceeding or any notice to that party. Such orders are meant to be temporary, until all parties can come before a court at a new hearing. The temporary order legally orders the accused person to stay away from the alleged victim, and to refrain from all communications of any type until a further Order is issued. In addition, the Court can suspend all visitation and communication with children, order temporary support, and order the Defendant to surrender all firearms.

Once the Defendant is served with the Restraining Order, both parties are notified to appear in Court at a new hearing. Each party may present evidence and testimony and the matter may then be set for a trial.
